The law, as it exists, has not translated into enforcement against individuals engaging in private, consensual activity at home. The legal grey area around private possession versus public use is significant, and legal experts and commentators have noted that the law's enforcement has historically targeted conduct in more public contexts.
The Public Debate
The July 2024 Supreme Court ruling sparked genuine national conversation. Public figures, media commentators and ordinary Ghanaians weighed in, and the debate has been far from one-sided. Many Ghanaians, including prominent voices, have argued that what consenting adults do privately in their own bedrooms should not be subject to criminal law. Even during parliamentary debate on related legislation, MPs raised concerns that overly broad provisions could unfairly affect heterosexual couples who use toys as part of their intimate lives.
This is an evolving conversation in Ghana, not a settled one. Public attitudes around sexual wellness are shifting, particularly among younger urban populations in Accra and other cities.
